Written Warranty Requirements

Under CR-78 Section 78.14, any dealer guarantee or warranty must be in writing and delivered to the purchaser. The written terms must include coverage scope, date or mileage limitations, and specific covered items. The warranty document is signed by the dealer or an authorized representative.

Third Party Warranty Providers

If coverage is sold or offered by a provider other than a factory warranty or direct dealer warranty, that provider must be authorized under New York Insurance Law Section 41.

Factory Warranty Remaining Period

If a new car is sold with less than the full new-car warranty remaining, the remaining period must be disclosed in writing on the bill of sale or invoice in a conspicuous manner.

Required Disclosures Before Purchase

  • Used-vehicle certification statement on qualifying used retail sales for use on NY public highways
  • Prior-use certification when the principal prior use is known or reasonably known (taxicab, rental, police, or driver education)
  • Written lemon-law repurchase notice before contract signing or deposit when applicable
  • Written notice before sale if title is branded RECONSTRUCTED or NON-USA-STD
  • Written salvage disclosure and bill-of-sale affirmation at first sale when applicable
  • Written non tamper-resistant odometer statement for used 1993 and newer vehicles when applicable

Used Vehicle Certification Required Statement

For qualifying used retail sales for operation on NY public highways, the required statement reads: If this motor vehicle is classified as a used motor vehicle, the dealer named above certifies that the entire vehicle is in condition and repair to render, under normal use, satisfactory and adequate service upon the public highway at the time of delivery.

Inspection Before Delivery

For vehicles sold for use on NY public highways, CR-78 requires a valid inspection certificate before delivery and inspection timing tied to the sale date, with listed exceptions in the regulation. Inspection and delivery records are documented in sale paperwork and dealer records.
